Terms of Service

These Terms of Service ("Terms") govern your use of the DigitifyZar website and services. By accessing our website or engaging our services, you agree to these Terms.

1. Services

DigitifyZar provides digital services including but not limited to web development, mobile app development, SEO, SaaS products, hosting, cloud infrastructure management, and related technology solutions.

2. Engagement Terms

  • All projects begin with a written proposal or statement of work (SOW) outlining scope, timeline, and pricing.
  • Changes to project scope require mutual written agreement and may affect timeline and pricing.
  • We offer NDA agreements for all engagements upon request.

3. Intellectual Property

  • Upon full payment, clients receive ownership of custom-developed deliverables as specified in the SOW.
  • DigitifyZar retains ownership of proprietary frameworks, tools, and pre-existing components used in development.
  • SaaS products are licensed, not sold. Usage is governed by the applicable SaaS License Agreement.

4. Payment Terms

  • Payment terms are specified in individual project agreements.
  • Hosting and SaaS subscriptions are billed monthly or annually as specified in the service agreement.
  • Late payments may result in service suspension after written notice.

5. Service Level Agreements

Hosting and cloud services are covered by our SLA, which guarantees 99.9% uptime (shared hosting) and 99.99% uptime (VPS and dedicated servers). SLA credits are provided for verified downtime exceeding the guaranteed threshold.

6. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives the termination of the agreement.

7. Limitation of Liability

DigitifyZar's liability is limited to the fees paid for the specific service in question. We are not liable for indirect, consequential, or incidental damages.

8. Termination

Either party may terminate an engagement with 30 days written notice. Upon termination, all completed deliverables and data will be transferred to the client.

9. Governing Law

These Terms are governed by the laws of the jurisdiction applicable to the client's service agreement location.
